Illinois Governor Rod Blagojevich arrested for trying to sell senate seat vacanted by now Mr. President Obama

CHICAGO - Illinois Governor Rod Blagojevich embarked on a "corruption crime spree" and tried to benefit from his ability to appoint President-elect Barack Obama's replacement in the U.S. Senate, federal officials said.

At a news conference in Chicago on Tuesday, U.S. Attorney Patrick Fitzgerald called it a sad day for the citizens of Illinois and alleged that the governor tried to "auction off" the Senate seat "to the highest bidder."

Blagojevich had been arrested hours earlier and was released later in the day after posting a $4,500 bond.

A 76-page FBI affidavit said the 51-year-old Democrat was intercepted on court-authorized wiretaps over the last month conspiring to sell or trade the vacant Senate seat for personal benefits for himself and his wife, Patti. Fitzgerald said federal investigators bugged Blagojevich's campaign offices and placed a tap on his home phone.

In Illinois, the governor selects a successor when there is a mid-term Senate vacancy. Obama resigned from the Senate soon after winning the Nov. 4 presidential election. With the governor's arrest, Illinois Senate President Emil Jones, Jr., said he will call the Senate back in session in order to create a special election for the U.S. Senate seat.

"I'm going to keep this Senate option for me a real possibility, you know, and therefore I can drive a hard bargain. You hear what I'm saying. According to surreptitiously recorded conversations, Blagojevich spoke with associates about the possibility of trading the Senate post for either an ambassadorship or a Cabinet post. The politician, according to the affidavit sworn by FBI Agent Daniel Cain, "analogized his situation to that of a sports agent shopping a potential free agent to various teams." During a wiretapped November 10 call, a frustrated and financially strapped Blagojevich referred to Obama as a "motherfucker" and said that he would not appoint an ally of the President-elect to the Senate vacancy if "I don't get anything." Referring to Obama, Blagojevich exclaimed, "Fuck him. For nothing? Fuck him." In a November 11 conversation, Blagojevich remarked that he knew Obama wanted Valerie Jarrett, a longtime confidante, to succeed him, "but they're not willing to give me anything except appreciation. Fuck them." Blagojevich, 51, and his chief of staff, John Harris, were arrested this morning on political corruption charges. While the affidavit does not specifically name the six prospective Senate candidates discussed by Blagojevic, Harris, and the governor's aides, it appears that several are easily identified. "Senate Candidate 1" is Jarrett. "Senate Candidate 2" is Illinois Attorney General Lisa Madigan. Emil Jones, an Illinois state legislator, is "Senate Candidate 5." [The Chicago Tribune and ABC News are reporting that "Senate Candidate 5" is Rep. Jesse Jackson Jr.] And "Senate Candidate 6" appears to be J.P. Pritzker, a wealthy Chicago businessman. Blogging
can result in
a range of
legal liabilities
and
other unforeseen consequences


Several cases have been brought before the national courts against bloggers concerning issues of defamation or liability. U.S. payouts related to blogging totaled $17.4 million by 2009; in some cases these have been covered by umbrella insurance. The courts have returned with mixed verdicts. Internet Service Providers (ISPs), in general, are immune from liability for information that originates with third parties (U.S. Communications Decency Act and the EU Directive 2000/31/EC). Blogging can sometimes have unforeseen consequences in politically sensitive areas. Blogs are much harder to control than broadcast or even print media. As a result, totalitarian and authoritarian regimes often seek to suppress blogs and/or to punish those who maintain them. Employees who blog about elements of their place of employment can begin to affect the brand recognition of their employer. In general, attempts by employee bloggers to protect themselves by maintaining anonymity have proved ineffective. One consequence of blogging is the possibility of attacks or threats against the blogger, sometimes without apparent reason. Kathy Sierra, author of the innocuous blog Creating Passionate Users, was the target of such vicious threats and misogynistic insults that she canceled her keynote speech at a technology conference in San Diego, fearing for her safety. While a blogger's anonymity is often tenuous, Internet trolls who would attack a blogger with threats or insults can be emboldened by anonymity. Sierra and supporters initiated an online discussion aimed at countering abusive online behavior and developed a blogger's code of conduct.

A few examples are as follows:

1)
In Doe v. Cahill, the Delaware Supreme Court held that stringent standards had to be met to unmask the anonymous posts of bloggers and also took the unusual step of dismissing the libel case itself (as unfounded under American libel law) rather than referring it back to the trial court for reconsideration. In a bizarre twist, the Cahills were able to obtain the identity of John Doe, who turned out to be the person they suspected: the town's mayor, Councilman Cahill's political rival. The Cahills amended their original complaint, and the mayor settled the case rather than going to trial.

2) In January 2007, two prominent Malaysian political bloggers, Jeff Ooi and Ahiruddin Attan, were sued by pro-government newspaper, The New Straits Times Press (Malaysia) Berhad, Kalimullah bin Masheerul Hassan, Hishamuddin bin Aun and Brenden John a/l John Pereira over an alleged defamation. The plaintiff was supported by the Malaysian government. Following the suit, the Malaysian government proposed to "register" all bloggers in Malaysia in order to better control parties against their interest. This is the first such legal case against bloggers in the country.

3) In the United States, blogger Aaron Wall was sued by Traffic Power for defamation and publication of trade secrets in 2005. According to Wired Magazine, Traffic Power had been "banned from Google for allegedly rigging search engine results." Wall and other "white hat" search engine optimization consultants had exposed Traffic Power in what they claim was an effort to protect the public. The case was watched by many bloggers because it addressed the murky legal question of who is liable for comments posted on blogs. The case was dismissed for lack of personal jurisdiction, and Traffic Power failed to appeal within the allowed time.

4) In 2009, a controversial and landmark decision by The Hon. Mr Justice Eady refused to grant an order to protect the anonymity of Richard Horton.

5) In 2009, NDTV issued a legal notice to Indian blogger Chetan Kunte for "abusive free speech" regarding a blog post criticizing their coverage of the Mumbai attacks. The blogger unconditionally withdrew his post, replacing it with legal undertaking and an admission that his post had been "defamatory and untrue" which resulted in several Indian bloggers criticizing NDTV for trying to silence critics.

6) In late 2004, Ellen Simonetti was fired for what was deemed by her employer, Delta Air Lines, to be inappropriate material on her blog. She subsequently wrote a book based on her blog.

7) Delta Air Lines fired flight attendant Ellen Simonetti because she posted photographs of herself in uniform on an airplane and because of comments posted on her blog "Queen of Sky: Diary of a Flight Attendant" which the employer deemed inappropriate. This case highlighted the issue of personal blogging and freedom of expression vs. employer rights and responsibilities, and so it received wide media attention. Simonetti took legal action against the airline for "wrongful termination, defamation of character and lost future wages". The suit was postponed while Delta was in bankruptcy proceedings (court docket).

8) In early 2006, Erik Ringmar, a tenured senior lecturer at the London School of Economics, was ordered by the convenor of his department to "take down and destroy" his blog in which he discussed the quality of education at the school.

9) Mark Cuban, owner of the Dallas Mavericks, was fined during the 2006 NBA playoffs for criticizing NBA officials on the court and in his blog.

10) Mark Jen was terminated in 2005 after 10 days of employment as an Assistant Product Manager at Google for discussing corporate secrets on his personal blog, then called 99zeros and hosted on the Google-owned Blogger service. He blogged about unreleased products and company finances a week before the company's earnings announcement. He was fired two days after he complied with his employer's request to remove the sensitive material from his blog.

11) In India, blogger Gaurav Sabnis resigned from IBM after his posts exposing the false claims of a management school, IIPM, led to management of IIPM threatening to burn their IBM laptops as a sign of protest against him.

12) Jessica Cutler, aka "The Washingtonienne", blogged about her sex life while employed as a congressional assistant. After the blog was discovered and she was fired,[64] she wrote a novel based on her experiences and blog: The Washingtonienne: A Novel. Cutler is presently being sued by one of her former lovers in a case that could establish the extent to which bloggers are obligated to protect the privacy of their real life associates.

13) Catherine Sanderson, a.k.a. Petite Anglaise, lost her job in Paris at a British accountancy firm because of blogging. Although given in the blog in a fairly anonymous manner, some of the descriptions of the firm and some of its people were less than flattering. Sanderson later won a compensation claim case against the British firm, however.

14) On the other hand, Penelope Trunk wrote an upbeat article in the Boston Globe back in 2006, entitled "Blogs 'essential' to a good career". She was one of the first journalists to point out that a large portion of bloggers are professionals and that a well-written blog can help attract employers.

15) In Singapore, two ethnic Chinese were imprisoned under the country’s anti-sedition law for posting anti-Muslim remarks in their blogs.

16) Egyptian blogger Kareem Amer was charged with insulting the Egyptian president Hosni Mubarak and an Islamic institution through his blog. It is the first time in the history of Egypt that a blogger was prosecuted. After a brief trial session that took place in Alexandria, the blogger was found guilty and sentenced to prison terms of three years for insulting Islam and inciting sedition, and one year for insulting Mubarak.

17) Egyptian blogger Abdel Monem Mahmoud was arrested in April 2007 for anti-government writings in his blog. Monem is a member of the banned Muslim Brotherhood.

18) After expressing opinions in his personal blog about the state of the Sudanese armed forces, Jan Pronk, United Nations Special Representative for the Sudan, was given three days notice to leave Sudan. The Sudanese army had demanded his deportation.

19) In Myanmar, Nay Phone Latt, a blogger, was sentenced to 20 years in jail for posting a cartoon critical of head of state Than Shwe.

Gujarat Chief Minister Narendra Modi is the first Chief Minister in the country to have been questioned on a criminal complaint

It is the first time in Indian history that a sitting Chief Minister has been accused and interrogated for a crime such as mass murder. The “will he won’t he” suspense eventually ended on March 27 when Gujarat Chief Minister Narendra Modi presented himself before the Special Investigation Team (SIT) to be interrogated for his alleged complicity in the 2002 riots. Modi is the first Chief Minister in the country to have been questioned on a criminal complaint.

Close to 1,500 people lost their lives in the days of rioting that followed the burning of a coach of the Sabarmati Express at Godhra, in which 59 kar sevaks returning from Ayodhya died. The investigation into the Godhra
incident and the Gujarat riots has been going on for eight years.

For a man who holds such a high office and, more importantly, is known for his power and control, this was a humbling experience. He is accused of aiding and abetting riots in Gulberg Society, a residential colony in Ahmedabad, where 68 people were killed in a mob attack on February 28, 2002. Modi has been indicted in a petition filed by Zakia Jafri, whose husband Ehsan Jafri, a former Congress Member of Parliament, was killed in the attack on Gulberg Society. Zakia Jafri has accused Modi and 62 others of instructing officials not to heed cries for help by Muslims during the riots. She says her husband made frantic calls to Modi and several police officers and politicians, but no one came to their aid. She believes that the attack on Gulberg Society was a planned one and that her husband was targeted.

Satyam Scandal - event line summary

The Satyam Computer Services scandal was publicly announced on 7 January 2009, when Chairman Ramalinga Raju confessed that Satyam's accounts had been falsified notifying board members and the Securities and Exchange Board of India (SEBI) & resigned from his seat.


Raju confessed that Satyam's balance sheet of 30 September 2008 contained:

* inflated figures for cash and bank balances of INR 5,040 crore (as against INR 5,361 crore reflected in the books).
* an accrued interest of INR 376 crore which was non-existent.
* an understated liability of INR 1,230 crore on account of funds was arranged by himself.
* an overstated debtors' position of INR 490 crore (as against INR 2,651 crore in the books).

Raju claimed in the same letter that neither he nor the managing director had benefited financially from the inflated revenues. He claimed that none of the board members had any knowledge of the situation in which the company was placed.

He stated that

"What started as a marginal gap between actual operating profit and the one reflected in the books of accounts continued to grow over the years. It has attained unmanageable proportions as the size of company operations grew significantly (annualised revenue run rate of Rs 11,276 crore in the September quarter of 2008 and official reserves of Rs 8,392 crore). As the promoters held a small percentage of equity, the concern was that poor performance would result in a takeover, thereby exposing the gap. The aborted Maytas acquisition deal was the last attempt to fill the fictitious assets with real ones. It was like riding a tiger, not knowing how to get off without being eaten.”

Aftermath:

Raju had appointed a task force to address the Maytas situation in the last few days before revealing the news of the accounting fraud. After the scandal broke, the then-board members elected Ram Mynampati to be Satyam's interim CEO. Mynampati's statement on Satyam's website said:

"We are obviously shocked by the contents of the letter. The senior leaders of Satyam stand united in their commitment to customers, associates, suppliers and all shareholders. We have gathered together at Hyderabad to strategize the way forward in light of this startling revelation."

On 10 January 2009, the Company Law Board decided to bar the current board of Satyam from functioning and appoint 10 nominal directors. "The current board has failed to do what they are supposed to do. The credibility of the IT industry should not be allowed to suffer." said Corporate Affairs Minister Prem Chand Gupta. Chartered accountants regulator ICAI issued show-cause notice to Satyam's auditor PricewaterhouseCoopers (PwC) on the accounts fudging. "We have asked PwC to reply within 21 days," ICAI President Ved Jain said.

On the same day, the Crime Investigation Department (CID) team picked up Vadlamani Srinivas, Satyam's then-CFO, for questioning. He was arrested later and kept in judicial custody.

On 11 January 2009, the government nominated noted banker Deepak Parekh, former NASSCOM chief Kiran Karnik and former SEBI member C Achuthan to Satyam's board.

Immediately following the news, Merrill Lynch (Now with Bank of America) terminated its engagement with the company.

Also, Credit Suisse suspended its coverage of Satyam.[citation needed]. It was also reported that Satyam's auditing firm PricewaterhouseCoopers will be scrutinized for complicity in this scandal.

SEBI, the stock market regulator, also said that, if found guilty, its license to work in India may be revoked.

Satyam was the 2008 winner of the coveted Golden Peacock Award for Corporate Governance under Risk Management and Compliance Issues, which was stripped from them in the aftermath of the scandal.

The New York Stock Exchange has halted trading in Satyam stock as of 7 January 2009.

India's National Stock Exchange has announced that it will remove Satyam from its S&P CNX Nifty 50-share index on January 12.

The founder of Satyam Ramalinga Raju was arrested two days after he admitted to falsifying the firm's accounts. Ramalinga Raju is charged with several offences, including criminal conspiracy, breach of trust, and forgery.

Satyam's shares fell to 11.50 rupees on 10 January 2009, their lowest level since March 1998, compared to a high of 544 rupees in 2008. In New York Stock Exchange Satyam shares peaked in 2008 at US$ 29.10; by March 2009 they were trading around US $1.80.

The Indian Government has stated that it may provide temporary direct or indirect liquidity support to the company. However, whether employment will continue at pre-crisis levels, particularly for new recruits, is questionable.

On 14 January 2009, Price Waterhouse, the Indian division of PricewaterhouseCoopers, announced that its reliance on potentially false information provided by the management of Satyam may have rendered its audit reports "inaccurate and unreliable".

On 22 January 2009, CID told in court that the actual number of employees is only 40,000 and not 53,000 as reported earlier and that Mr. Raju had been allegedly withdrawing INR 20 crore rupees every month for paying these 13,000 non-existent employees.

On 5th February 2009, the six-member board appointed by the Government of India named A. S. Murthy as the new CEO of the firm with immediate effect. Murthy, an electrical engineer, has been with Satyam since January 1994 and was heading the Global Delivery Section before being appointed as CEO of the company. The two-day-long board meeting also appointed Homi Khusrokhan (formerly with Tata Chemicals) and Partho Datta, a Chartered Accountant as special advisors.

In March 2009 the company announced it would begin soliciting bids from potential buyers.

On April 13, 2009, Kiran Karnik, the MD at Satyam announced that IT services provider Tech Mahindra had offered the highest bid at Rs 58 per share.

Tech Mahindra will have to pay a total of Rs 2890 crore for 51% stake in Satyam. and the IT company will have a market cap of Rs 5,666 crore on expanded equity. A US-based investment firm owned by billionaire Wilbur Ross and an Indian construction and IT services firm, Larsen and Toubro were the other bidders. Cognizant Technology Solutions had expressed its interest in a joint bid with Wilbur Ross but backed out at the end.
